These terms are an agreement between you and Vyndigital, a business run by a sole trader in Western Australia, Australia. They cover your use of Pencil, the drawing service on this site. By getting a key or using Pencil, you agree to them. If you don't agree, don't use Pencil.
Pencil is an MCP service. It lets an AI assistant you choose draw pictures by sending drawing instructions to our server, which renders them and sends back the picture. Vyndigital is not affiliated with, endorsed by or connected to any AI assistant provider.
You must be 18 or over, or have a parent or guardian's permission. If you use Pencil for a business, you confirm you can agree to these terms for it.
Your key is shown once. Keep it secret: anyone with it can use your renders, and you're responsible for use of your key. If it leaks, email us and we'll replace it. One person or business per key. Don't share, sell or resell keys or access.
Don't use Pencil to:
We may suspend or close a key that breaks these rules.
What you make with Pencil is yours, as far as the law allows. You're responsible for how you use it. AI-made drawings can look like existing work, so check a logo or brand mark before you rely on it, for example by searching the IP Australia trade marks register. We claim no rights in your drawings beyond storing and processing them to run the service.
Pro is billed monthly in advance through Stripe until you cancel. Cancel any time by asking your AI to run pencil_account with manage: true, or by emailing us. Cancelling stops the next charge, and Pro stays active until the end of the month you paid for. See the refund policy.
We work to keep Pencil running, but we can't promise it will never be down, slow or have errors. We may improve or change features. We'll email Pro users at least 14 days before a price change, or a change that materially reduces what Pro includes, and you can cancel before it applies.
Pencil comes with guarantees under the Australian Consumer Law that can't be excluded. Nothing in these terms limits them.
Apart from those guarantees, and as far as the law allows: we're not liable for indirect or consequential loss, such as lost profits or data, and our total liability to you is limited to the fees you paid us in the 3 months before the claim. Where the law lets us limit our liability for failing a consumer guarantee, it's limited to supplying the service again or refunding what you paid for it.
You can stop using Pencil and ask us to delete your account at any time. We may end these terms if you seriously break them, or if we stop running Pencil. If we stop running Pencil, we'll give Pro users at least 30 days' notice and refund unused paid time.
These terms are governed by the law of Western Australia, Australia.
